Well, while I certainly do not wish to see "innocent" people harmed, the idea of taking away habeas corpus from non-citizens is actually a constitutional provision. Article I, Section 9 of the Constitution (which deals with immigration and importation of foreigners) states:

"The privelege of the writ of habeas corpus shall not be suspended, unless when in casees of rebellion or invasion, the public safety may require it."

Frankly, while I don't want to see innocent people hurt, I'd rather see a few "innocent" foreigners captured and held than thousands or more Americans harmed or killed because we failed to do something or because we were "afraid" of infringing on the "rights" of non-citizens.

Hello, I was wondering why there is no dialogue on the media about what is happening to the people held at Guantanamo or other places not known, being treated not as as human beings, just being forgotten.
What can a person do?

Good god Mark? What is an American right? Is it a right that we take for granted but now we have decided is too good for others. People like Adel did not choose to come here - and now you are saying because they are foreign they cannot enjoy American rights - then let them out of American.
And anyway habeus corpus is not an American right. It is the standard of every civilised country in the world - a minimum standard - not one given only to those we choose to give it to. I remember when America was a civilised country.

[...] I’m not terribly concerned about the existence of the military commissions. I am, however, very concerned that detainees accused of terrorism get something resembling a fair trial. We’ve seen too many innocent people pass through Guantanamo, and those people should be able to challenge their detention. I don’t believe we’ve yet reached the point where we need to throw out the rule of law (PDF) in dealing with terrorism. Comments RSS - Trackback URI [...]

[...] Back then, you had innocent people deported to England to stand trial on trumped-up charges. Today you have innocent people railroaded into guilty pleas by legal maneuvering, innocent people on death row for defending themselves from abuse of power, innocent people in Guantanamo Bay without a trial at all. You’re not supposed to be so blind with patriotism that you can’t face reality. Wrong is wrong no matter who does it or who says it. — Malcolm X [...]

[...] While the five had been declared not enemy combatants by a military tribunal, the U.S. did not release them back to their home country, because it said that they would face persecution from the Chinese government. [...]

I’m sympathetic to their cause, to be sure, but I severely doubt that giving non-Americans American rights is prudent.

You know giving nick berg iraqi rights just doesn't make sense. I guess if they want to execute him as an "enemy combatant" I'm ok with it. Shit happens!!

[...] In Britain, under the Prevention of Terrorism Act, one is suspected of terrorism for participating in a film about terrorism, or a film about three men who had nothing to do with terrorism, as “an unknown number” of detainees in the Halliburton-built Guantanamo, including a ten year old boy, have nothing to do with terrorism.
