Good question Sally. My guess is that if sued, the City of New London could claim governmental immunity. A legal defense which shields local governments from liability in cases of bad judgment by public officials. The justification for governmental immunity is that it protects executive, representational local policy decisions from second guessing by courts. Claims of governmental immunity can be disqualified. For instance, if public officials who caused injury were motivated by malice. However, motivation is difficult to prove legally. I'd also guess that many of the folks who fought the good fight in Fort Trumbull are sick to death of litigation and never want to see the inside of a court again.

Can't someone sue New London?! I mean, by this time they have violated the law as set forth via the court's ruling in 2005. A per the judgement, the land was taken due to the fact that the public/private use of the land would benefit socitey in terms of a $$ gain. At this point in time there have been greater losses then gains, and thus MUST voilate the law!

There are no time lines on the law, just results...no results.

Anyone want to take them on again?

Yeah and this type of thing suprises who. It is about time that we stopped this. It is one thing to use this function as a part of say road building. Even the building of things like fire stations and schools which have to more less be in a specific place is a logical use. This economic development thing is something else.
