Nationally syndicated radio talk show host Ian Freeman will spend 100 days in jail because he questioned the legitimacy of a system which would penalize him for having a couch in his yard and conduct his trial in secret.
Keene resident Nick Ryder wrote on the Free Keene blog that the courtroom at Freeman’s trial Friday afternoon at Keene District Court in Keene, N.H., was stacked with police “to try and outnumber the liberty activists.”
Judge Edward Burke had hardly arrived in the courtroom before ordering Freeman jailed for 30 days for contempt of court and the proceedings moved to another room where spectators would not be allowed to hear what happened. Video of the beginning of the proceeding indicates that Freeman’s arrest may have been orchestrated in advance and may have taken place regardless of what occurred in open court, according to witnesses.
When word finally filtered out of the closed proceeding, Freeman had somehow gotten two more 30-day sentences for contempt and 10 days for refusing to pay a fine for having an illegal couch. The official reasons for the contempt charges were not immediately clear.
“It was oppressive,” said Dale Everett, 40, of Keene. “They had a notice posted obviously targeting us, liberty activists, saying that anyone who didn’t stand for the judge would be ‘subject to sanction.’ So I left. I wasn’t prepared to get arrested today.”
Freeman is the owner and host of the Free Talk Live radio show, which airs six nights a week on approximately 45 radio stations nationwide. Free Talk Live is an open format show, where callers can bring up any topic, with no caller refused. The hosts bring a libertarian perspective to the ensuing conversations.
The controversy began in August when Keene housing inspector Carl Patten visited Freeman’s duplex, half of which he rents out, and cited him for a couch on his tenants’ side of the yard.
Freeman said at the time he did not believe the city had a right to tell him whether he could have a couch on his yard. The couch was decorated for Halloween, complete with a pumpkin and lounging scarecrow.
After refusing to pay the fine and being threatened with arrest at his first hearing, Freeman attempted to negotiate with the city.
Patten claimed that he cited Freeman after receiving a complaint. Freeman said he would remove the couch if given an opportunity to speak to the original complainant, “like an adult, instead of calling in men with guns.” The city refused and demanded he come to trial Friday, where he was jailed for contempt almost immediately.
“The Judge sees himself as royalty,” wrote Jim Johnson of Winchester on the New Hampshire Underground forum, “no one may question or disrespect his benevolent self.”
Code enforcement activity has been on the rise nationwide with the failing economy reducing local governments’ revenues and local bureaucrats desperately trying to take money from anywhere they can get it, using any excuse.
Free Talk Live recently interviewed one victim of code enforcement, 83 year old Ageda Camargo of La Quinta, Calif., who is being harassed by bureaucrats there over a garage which was converted into a bedroom decades ago, before she bought the house.
When the laws are unjust, as the vast majority of today’s laws are, then a court of law will dispense injustice. Freeman’s protest of the injustice done to him has not gone unnoticed. Many liberty activists have said the court’s action has motivated them to get even more involved.
“The tyranny was stifling,” Everett said. “It’s the kind of experience that makes you rethink everything. And just to be clear, I don’t mean rethinking everything in terms of backing off. Quite the opposite.”

The whole “justice system” in, whats left of this country, is criminally negligent, abusive of power, corrupt, dysfunctional, and must be completely destroyed, or abolished. The lie that, one is innocent, until proven guilty, is a complete farce, in actuality if your on trial, you are automatically guilty, unless you can prove beyond any doubt that your not. This refers to what is clear in the video; they took him to a separate room instead of conducting the trial properly in front of the public. What logical reason is there for that? The audience only got to watch the trial on a small TV screen what looks to be dozen of meters away and I wonder if it even had the audio turned loud enough.
So even if it wasn’t exactly secret, it was clearly unusual and impractical and I wouldn’t be surprised if it was intended to put more pressure on him by separating him from supporters.

This, plus the NH election results, might help explain why the Free State Project has had such dismal success in convincing libertarians to move to the “Live Free or Die” state. While it is nice to see that one resident is committed to liberty, its not clear that nearly enough are to make it worth picking up and moving to a frigid northern hinterland.
(To be fair to NH, I will admit, that a lack of commitment amongst libertarians can clearly be identified as a problem.)

Mr. Beach, NO ONE can be accused anonymously in this country, because the Sixth Amendment to the Constitution guaranteeds the right to “be confronted with the witnesses against him” in a ciminal prosecution. That is why the accuser in such a “malum prohibitum” case — i.e., a law which does not constitute any real crime against any person’s life, liberty, or property — is usually a government official, such as a police officer or bureacrat. The government official pretends to be the complainant, even though he has no damage against himself, his liberty, or his property. Such official puports to represent the government, but of course the “government” has no life or liberty to be damaged, only property. And there is no property damage here, only a bogus law invading the people’s right to their own property and its use. The law is utterly ludicrous and is merely a governmental means to steal from the people. Anyone with the cowardice to accuse another of such a noncrime anonymously is a traitor and a willing participant in theft, not to mention an accessory to the kidnapping of a man who has harmed no one.

The problem is that these are considered “civil matters”. The normal protections of the constitution are said not to apply. I think we will need to start looking at this and saying that maybe they should.

My parents have kept old couches and chairs outside of their house for years and nobody here in Iowa has said a thing about them and not one child has died or even gotten sick because of the living furniture being moved outside. Usually the cats who keep the mouse and rat population in check for them uses the couches and chairs in the winter to keep warm. My parents also have put big boxes over the chair to block the wind, so not only are they dirty, but they’re ugly as well, yet not a single complaint from neighbors. Of course they’re going after Ian because he’s an activist, unlike my parents. I bet there isn’t even anyone really complaining about it, the city officials in Keene found a little thing to go after him on and they’re going all the way with it.

There have been several cases involving proceedings like this. All of them have cost the governments involved millions of dollars. Of course the actual individuals involved had nothing happen to them. It is time that people were actually held accountable for their actions.

As for the sixth amendment issue, there isn’t one. Carl Patten is, for the purposes here, the accuser and witnesses abound. To say there’s a sixth amendment issue clouds the topic’s real issues and gives the opponent a straw man to attack.

That’s really the point, isn’t it? There is no actual person complaining. It’s the “City of Keene,” whatever that is, that’s attacking something it doesn’t like (liberty.) The couch was just an opportunity for them, and they’re hiding the fact behind this mechanism that “protects complainants.”

I remember the teams of Marshals and state troopers from three states that went after Ed and Elaine Brown when all they asked was to be shown the law that says that they had to pay the Federal Income Tax.
One good thing about this crashed economy is that they will have to lay off a lot of their police thugs. Reconsider whether or not you are a tax payer by reading Cracking the Code by Peter Hendrickson. No taxes without representation. Cut off the money to this thugs do not pay for your oppression.

Defendants are then told “All Rise.” It seems that they are rising for the Judge. In fact, court rules require that the standing is supposed to honor the principles for which this state stands. The judge is supposed to face the flag. There is a specified speech.

That doesn’t prevent me from making an anonymous complaint against another person – it simply means that I can’t testify to the facts of the case anonymously. Tom could tell the police that Dick murdered someone, but would never have to take the stand himself if Harry were a witness to the crime. But the prosecution couldn’t introduce statements from Tom as evidence, he refused to be identified. If Sally calls the police to report Jane stealing from Jill’s home, and the police catch her in the act, they don’t need to follow up with Sally – they can testify to the crime themselves, and cross-examination would attempt to impeach them.
But more importantly to this particular case, the right to confront witnesses does not allow one to be able to contact witnesses independently of court proceedings – otherwise I suspect that witness coercion would be rampant.

Here’s what I see really happening here, just like an episode of cops:
Freeman was served notice to remove the couch (Yes, people have a right to complain and maintain anonymity). The cops showed up when he did not remove it, and he got just as mouthy about his rights (just like all of you on here). The cops probably told him to calm down, he continued to refuse to remove the couch, and they arrested him for disobeying a court order. It is the law at work. I don’t give a s**t if it was just a couch. It was a court order.
Next, he goes to court: First, he did not appropriately address the court (probably being just as rude as some of you on here)and he probably spoke out when he was supposed to be listening (all he needed to know he should have learned in Kindergarten!!!). So, the judge orders him in contempt of court. So on and so on….
This is what happens when ANYONE disobeys a court order, then is disrespectful in court. Get over it. Move on to something more important than an activist with a nasty couch. Go out and make a REAL difference!

Substandard exterior home conditions (including indoor furniture on the front lawn) are among the biggest signs of a community’s decline and can directly influence a home’s resell value. As such, communities have enacted standards to which owners must maintain their properties. Freeman knew of this ordinance but disagreed with it. He was cited for an ordinance violation and ordered to appear in court. (As others have correctly posted, there is Freeman has no right to confront the original complaintant nor does he have the right to disregard the procedural rules of the court.)At the start of the hearing, Freeman refused to stand when the judge entered into the courtroom and refused to address the judge in an appropriate manner. He was given a warning and instructed as to how to properly address the court. He refused to acknowledge that instruction. As such, he was charged for being in contempt of court at which time various observing members of the gallery began vocalizing their support for Freeman. The hearing was then moved to another room closed to the public. There, Freeman continued his contemptuous behavior and speech and was charged twice more. (And, just for the record, this is not my opinion but rather an accurate recollection of the event – far more honest than the poorly edited and highly biased version posted to YouTube, eh Hampton?)

First the Supreme court has already ruled on the standing issue. Only if he were a lawyer or an officer of the court could this be contempt of court.
Second the closed hearing was illegal. The solution to the noisy court room is to either also cite those who refuse to be quite, or clear the courtroom and then try again. A closed court is only an available option for immediately threat of violence, and then not available as an option for any final dispositions, but only for purposes of hearing matter specifically related to continuing the case, and how to secure the situation so violence will not occur. None of which apply here.
There have already been a number of communities who have tried this kind of behavior and have had to pay out a few mill to those on the other side. Lets hope this community also has to do so.
I will agree that probably the complaining person does not have to be identified. This depends a little upon the exact law. But I do wonder why they picked this fight in the first place. If you will remember the specific case details, this sofa was in fact part of a Halloween decoration setup. One question is if this set of decorations was the only one in the town that violated the ordinances.

I think that it would have been interesting to bring into it any decorations on the city official’s lawns and houses. I might have tried to bring the entire town in as witnesses. The judge would not have probably allowed it, but it sure would have made for an interesting time. It would seem to me that the real solution would be to have purchased all of the left over Halloween decorations after the holiday, put them up on the lawn and house legally. With note as to why prominently displayed. I can assure you this would have a whole lot more effect on property values than a sofa on the lawn over Halloween.

Hey Storm, read #17 up above. That attitude is going to become more and more common as times get tougher. When people are broke, they get mad. They might even get hungry. When people get mad and hungry, they might throw just about anything out on their lawn and you can be sure that in their minds, they will have a damn good reason for doing so. Trying to impose fines and jail time on someone for having unsightly objects on their lawn is soon going to get cops beaten or shot, especially if they come knockin’ six months after the perpetrators have lost their jobs.

The justice system better get back to serving up justice, instead of enforcing stupid laws and collecting fines. Patience is going to wear thin for that type of crap. You get average Joe American mad and the Rodney King riots will look like kids playing in the park.

Another method law enforcement is using to force people to commit a crime is by doing things that cost them a great deal of money such as repairs that are not covered by insurance such as tire repairs. This can be prevented and you can come out a winner. What you do is go to a discounted tire place get free road hazard repair and pay a small free where they will replace the whole tire free if something has damaged it. This will save time, headaches, money and you will come out ahead of these dirty bastards. Take a bite out of cop crime and WIN big. Hell who does not like free tire replacement? IT is like getting a free Christmas pressent early and it is cheap too. Nothing’s gonna stop us now!!

Everyone has been watching the investigation of Miss. Anthony regarding Caylee Anthony. If her Mom would go ,as far as, to lie to the FBI by giving false information and the wrong hair brush she must know that the girl is dead. Her daughter was very low-income and could not afford gas to drive allover. Her car was dead her ex-cop boyfriend said. Her daughter could be in a shallow grave in the back yard. Her father was an ex-cop who could have easily lied too. In this sick twisted family with corrupt cops involved it is easy to see that would be a place they would never look or find the body. They need to search there. She may have told her Mom she killed the girl by accident. The child may have had behavioral problems or a disablity that annoyed the grandmother too. The photo from Orlando at the mall clearly ressembles the mother sitting on the bench in front of her if you look at the facial structure and ect.. Let’s hope for the sake of American children they find the answer.

I have been around people like this. They are total sociopaths. They do not care about anyone but, themselves. They would not stop at killing a relative if it put a halt to thier fun or any thing in thier make-believe world of la la land. Child abuse happens every day and can lead to horrifick acts of violence like what happened to this girl. In order to stop it they should teach more birth control methods, bring back old fashioned family values and if a mother wants to put a child up for adoption such as Caysee did they should let her. Unwanted children cause many problems in society. Many become abusive mean criminals and even killers. You can see the sadness in the child’s eyes in her photo on the bed. She knows her Mom did not want her and she was depressed. The sad truth is this all could have been prevented. If people don’t want kids don’t have them. Use a rubber or get the pill. Too many lives are ruined by careless people just out for a thrill. Human life is at stake not, who can party and have the most orgasms. Forget about all that and do what is right.

Actually it has a lot to do with this sight. The Anthony family father is a cop and the Caysee who got in trouble’s boyfriend was an ex cop. Before she killed the girl he had told her he did not want any girl children. There is corruption at work and corrupt cops need to be exposed. This is a great sight for doing so. It also has to do with this thread because, it is another prime example of how shit happens when corruption is allowed to be.

I just think we should pay attention to the point here.
The point of this thread is to discuss the misbehavior and abuse of power by a judge in a specific case that has nothing to do with the Anthony case. To bring it up is abuse of this site and does annoy me. This is a serious matter and to serious of a matter to sideline with this abuse.
The site itself here is to discuss security and its abuse. There are some parts of the the Anthony situation that does limitedly apply to the site purpose, but most does not. I think that one area that most applies is the fact that many of the protesters are not in jail. From what I have seen of the video a few hundred of the protesters at the Anthony homes should now be serving time. From the video 30-90 day sentences should be common, and I have seen at least three events which should require a year or more. They seem to believe that they have the right to trespass on and even damage private property. They in all probability don’t even have the legal right to protest on public property in this case. I would suspect that one of the reasons that the police there is not hiring some “paddy buses” and carting these people off is that they are all for the protesters putting pressure on the family. On the other hand if I was the defense if this does go to trial I would move for a full dismissal on the basis of this a lot of other things I am seeing here for proprietorial misconduct.
As I said if you want to discuss this get the site manager to start another thread. But you won’t like the results.
No I am not a cop. Several of the cops here can tell you that they are frequently upset with me for what I tell them.

I was re-reading my post #12. It sounds like I am promoting intimidation as the way to get what you want. That’s not how I meant it.
People with character and principles(good or bad)will not back down when threatened, IF they stand for something and believe in what they are doing. If we are wrongfully pushed, it is our duty to push back.
People without character and principles will wilt when faced with a real threat but they will do whatever they can get away with in the meantime.
Strong opposition to a weasel of a judge will smarten that judge up, just the same as a strong justice system will reduce criminal behavior. It works both ways.
Someone complained because they didn’t like the way Ian Freeman kept his yard. HIS YARD. The judge acted on that complaint and attempted to punish Ian Freeman for the way he looked after HIS property. When Mr. Freeman tried to object, the judge cited him for contempt and had him forcibly confined for a number of days. Exactly who has contempt for who?
There are undoubtedly, far more serious crimes going unpunished in this country(as our somewhat looney friend has been pointing out) and the justice system spending taxpayer money in an effort to force people to properly dispose of their old furniture, is a waste.
I think in this case, where the judge has obviously abused his authority, a stern talking to by a few concerned citizens would do wonders for his contemptuous attitude.
In the words of Hank Williams Junior, this judge needs an attitude adjustment. He was wrong and needs to be made aware of that fact.

A huge scam that has been going on for decades is there are these scuzy home builders that do everything wrong on houses to try to use thier cheap scum ass law enforcement buddies to buy houses for cheap by doing so. They also try to kill the people buying the houses. Prime examples hooking up things wrong such as the airconditioner to cause huge bills. They also do not connect the overflow on bathtubs to cause extensive damage then try not to cover it. The list goes on and on. They also do not do the electricity hook up to cause more problems and huge bills. Before you buy a brand new house be sure to have your plumbing inspected before all walls are put up, have the electricity inspected and everything else with a different source or you will get screwed. I did 2 days for contempt when I did not stand for the aho, (administrative hearing officer) and threatened by another aho, same county with the same if I did not stand up for him. These criminal thugs disguised in black robes behind respectability are out of control. When you begin to really comprehend what is happening in these dens of corruption, (courts)you can see more crimes being committed in one hour in these fraudulent de-facto corporate dog and pony shows, then you will ever see in your entire life out on the street. This doesn’t cover the executive side who are there to enforce the bidding of these top thugs right or wrong. Absolute power, corrupts absolutely and it is next to impossible to convince someone of the truth when their pay checks depend on them not knowing the truth. We call it PFP, (policing for profit).
